Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Forge platform and the Cryptek Labs website (collectively, the “Services”). By accessing, subscribing to, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Cryptek Labs, Inc. (“Cryptek”, “we”, “us”, “our”) operates Forge, an AI-powered content generation system providing automated marketing assets for small businesses.

1. Definitions

“Account” means a user profile provisioned after a successful paid subscription.

“Brand Initiation Brief” means the intake data provided by you to generate your Brand Strategy Blueprint.

“Content Package” means downloadable files produced by Forge, including blogs, social media posts, images, prompts, and related assets.

“Generated Output” means any AI-produced text, data, or images provided to you by the Services.

“User Inputs” means any information you submit, including brand information, preferences, uploaded text, or creative direction.

“Plan” means a subscription tier, including Forge Build and Forge Scale.

2. Services Provided

Forge provides:

  • AI-generated content (blogs, social posts, prompts, image prompts).
  • Brand analysis and a Brand Strategy Blueprint.
  • Social scheduling tools (current or upcoming).
  • Downloadable content packages.
  • User dashboards for managing content cycles.
  • Support ticket access.
  • Automated monthly content cycle generation.

Cryptek does not provide training, onboarding, or access to internal system templates.

3. Eligibility

You must be 18 years or older and able to form a binding contract to use the Services.

Commercial use of the Services is limited to marketing your own business and does not include resale, sublicensing, or redistribution of the Services, the system, or underlying processes.

4. Account Registration

Accounts are automatically created after successful payment through Stripe.

You are responsible for:

  • Keeping your login credentials secure.
  • Ensuring all information provided is accurate and up to date.
  • All activities performed under your Account.

In the future, Accounts may support multiple brands under one user profile.

Cryptek may terminate or suspend Accounts, with or without notice, for:

  • Abuse or misuse of the Services.
  • Non-payment or failed payments.
  • High-volume API or automation stress.
  • Publishing or generating harmful, violent, or illegal content.
  • Fraud, fake brands, or other deceptive activities.
  • Any activity deemed harmful to Cryptek, its vendors, or its user base.

5. Subscriptions, Billing, and Trials

5.1 Subscription Plans

The Services are offered on a monthly subscription basis under the following Plans:

  • Forge Build (includes a 7-day trial).
  • Forge Scale (no trial).

Subscription pricing is managed externally and is not listed in these Terms.

5.2 Auto-Renewal

Subscriptions renew automatically each month until cancelled by you or by Cryptek.

5.3 Refunds

Refunds are only issued if the system fails to operate for the majority of a given month, in which case any refund will be calculated on a prorated basis.

No refunds are offered for:

  • User dissatisfaction with content quality.
  • Misuse of the platform.
  • Failure to download content before cancellation.

5.4 Cancellations

You may cancel at any time. Access to the Services will continue until the end of the then-current billing period.

6. Payment Processing

Stripe is the sole payment processor for the Services.

Cryptek:

  • Does not store or process credit card numbers.
  • Is not responsible for Stripe-based payment failures.
  • Requires billing disputes related to charges to be made through Stripe.

7. AI-Generated Content and User Responsibilities

Forge generates content automatically using AI models. As a result:

7.1 Ownership

You own all Generated Output created for your brand through the Services.

Cryptek retains ownership of the platform, system, workflows, and underlying models.

7.2 Required User Review

You must review and approve all content before publishing it publicly or using it in any external channel.

7.3 Disclaimers

Cryptek is not liable for:

  • Inaccurate, incomplete, misleading, or outdated content.
  • Content that violates regulations, including medical, legal, political, or financial claims.
  • Defamatory, harmful, or offensive statements in AI-generated text.
  • Any losses, damages, or consequences resulting from publication or use of Generated Output.
  • Any decisions, strategies, or actions you take based on Generated Output.

8. Acceptable Use Policy

You may not use the Services to:

  • Generate or distribute illegal content.
  • Produce content that constitutes harassment, hate speech, abuse, violence, or extremism.
  • Develop content for regulated industries (including but not limited to medical, legal, political, or financial advice) without independent review by qualified professionals.
  • Upload personal, sensitive, or confidential information (including personally identifiable information, or “PII”) to the Brand Initiation Brief or other inputs.
  • Scrape, extract, or automate access to Forge outside supported integrations and workflows.
  • Reverse engineer, decompile, or otherwise attempt to derive the source code, models, or architecture behind the Services.
  • Resell, sublicense, or redistribute Forge outputs as a standalone product or service.
  • Use outputs to train or improve competing AI-driven content systems.
  • Create fraudulent, deceptive, or fake brand profiles or campaigns.
  • Target individuals or groups with harmful, defamatory, or abusive narratives.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your Account and access to the Services.

9. Intellectual Property & Licensing

9.1 User Inputs

You grant Cryptek a non-exclusive, worldwide, royalty-free license to use your User Inputs solely for:

  • Providing and operating the Services.
  • Improving Forge internally.
  • Aggregated and anonymized analysis of usage patterns and performance.

Cryptek will not use User Inputs for model fine-tuning or training external foundation models.

9.2 Generated Outputs

You own Generated Outputs, subject to the following restrictions:

  • You may not resell, re-license, or redistribute Generated Outputs as a standalone content product or content-generation service.
  • You may not use Generated Outputs to train or improve competing AI systems.

9.3 Cryptek IP

All platform components—including workflows, templates, dashboards, processes, system designs, documentation, and any related intellectual property—remain the exclusive property of Cryptek.

You may not:

  • Redistribute system templates or internal configuration.
  • Republish documentation or operational processes as your own.
  • Remove Cryptek attribution where it appears in or on the Services or associated materials.

10. Data Handling, Retention & Deletion

10.1 Retention

User data, content packages, and brand information are stored indefinitely, unless and until a deletion request is submitted by you or your Account is closed and deletion is requested.

10.2 Deletion Requests

You may request permanent deletion of:

  • Brand Initiation data.
  • Content packages and Generated Outputs stored on our systems.
  • Account profile information and associated records.

Deletion requests may require identity verification and may be subject to retention obligations under applicable law.

10.3 GDPR & CCPA

Cryptek seeks to comply with the principles of applicable data protection laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), where applicable. Subject to legal limitations, you may have rights to:

  • Access personal data we hold about you.
  • Request deletion of your personal data.
  • Request correction of inaccurate personal data.
  • Request data portability.
  • Restrict certain processing activities.

11. Third-Party Services

Cryptek uses third-party services, including but not limited to:

  • OpenAI (AI model provider).
  • Airtable (data storage and workflow support).
  • Stripe (payments).
  • WordPress (dashboard and website framework).
  • Google Fonts and related CDN resources.

Cryptek is not liable for outages, failures, errors, data loss, or downtime caused by third-party providers or their infrastructure.

12. Service Reliability

Cryptek does not guarantee:

  • Uninterrupted uptime or availability of the Services.
  • Access to the Services at all times or from all locations.
  • Freedom from bugs, errors, or delays.

Downtime or service degradation may occur due to, without limitation:

  • OpenAI outages or degraded performance.
  • Airtable outages or issues.
  • Network interruptions, DDoS attacks, or other security events.
  • System updates, maintenance, or configuration changes.
  • General cloud or infrastructure failures outside Cryptek’s direct control.

Cryptek is not responsible for:

  • Lost data or corrupted records.
  • Delayed content delivery or delayed campaign readiness.
  • API failures or rate limiting.
  • Temporary unavailability of any portion of the Services.

13. Termination

Cryptek may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, if:

  • You violate these Terms.
  • You fail to pay any applicable fees.
  • Cryptek suspects fraud, abuse, or illegal activity.
  • Your use of the Services poses a security, legal, or operational risk.

Upon termination:

  • Your license to use the Services ends immediately.
  • Access to dashboards and stored data may cease.
  • Previously delivered Generated Outputs remain yours, subject to these Terms.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Cryptek and its officers, directors, employees, and agents will not be liable for any:

  • Indirect, incidental, special, punitive, exemplary, or consequential damages.
  • Loss of revenue, profits, customers, opportunities, or business.
  • Reputational damages arising from any content you publish.
  • Damages arising from User Inputs or Generated Outputs.
  • Damages resulting from failures of third-party services or infrastructure.

Your exclusive remedy for dissatisfaction with the Services is to stop using the Services and cancel your subscription.

15. Indemnification

You agree to indemnify, defend, and hold harmless Cryptek and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your access to or use of the Services.
  • Your publication, distribution, or other use of Generated Outputs.
  • Your violation of these Terms or applicable law.
  • Any infringement, defamation, or regulatory violation caused by content you submit or publish.

16. Class Action Waiver

You agree that any disputes or claims arising out of or relating to these Terms or the Services will be resolved on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action.

17. Governing Law

These Terms and any disputes arising out of or in connection with them are governed by the laws of the Province of British Columbia and the laws of Canada, without regard to conflict-of-law principles.

You agree to submit to the exclusive jurisdiction of the courts of the Province of British Columbia for the resolution of any disputes arising out of or relating to these Terms or the Services.

18. Modifications to the Terms

Cryptek may update or modify these Terms from time to time. When material changes are made, we may provide notice through the Services, by email, or by updating the “Effective Date” at the top of these Terms.

Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
